Making Sense of the New Overtime Rule

On May 18, 2016, the U.S. Department of Labor issued a new Overtime Rule affecting the regulations on overtime pay: Defining and Delimiting the Exemptions for Executive, Administrative, Professional, Outside Sales and Computer Employees. The rule increased the standard White Collar and Highly Compensated Employee salary thresholds. It also allows up to ten percent of the new White Collar salary threshold to be made up by non-discretionary incentive pay.

NLBMDA will host a webinar on the Department of Labor's NEW Overtime Rule on June 29 at 2:00 PM, Eastern Daylight Time. On May 18, 2016, the U.S. Department of Labor issued a new Overtime Rule affecting the regulations on overtime pay: Defining and Delimiting the Exemptions for Executive, Administrative, Professional, Outside Sales and Computer Employees. The rule increased the standard White Collar and Highly Compensated Employee salary thresholds. It also allows up to ten percent of the new White Collar salary threshold to be made up by non-discretionary incentive pay. The rule with its new salary thresholds goes into effect on December 1, 2016 and the thresholds will automatically increase once every three years, with the first increase set for January 2020.

The NLBMDA webinar will review what has changed, what has not changed, and give a special look at the key tests that must be met in order for an employee to be classified as exempt from overtime pay under the Fair Labor Standards Act. This will include a review of the duties tests applicable to Executive, Administrative and Professional employees and the exemptions that remain in place for Outside Sales and Motor Carrier workers. NLBMDA members are welcome to submit their questions at the time of registration to ensure the webinar addresses all scenarios and concerns applicable to the LBM sector. This webinar is benefit of membership through your State and Regional Associations.

About the Instructor:
Frank Moore, NLBMDA's Regulatory Counsel, will review the Wage and Hour's proposed overtime rule and the new independent contractor interpretation and facilitate an online discussion on the implication these will have on our sector. Frank has worked with NLBMDA for the past 7 years and has served in a government relations and counseling capacity for trade groups for over 25 years. He has also served as staff counsel on the former Committee on Banking, Finance and Urban Affairs in the U.S. House of Representatives.
