The Department of Labor’s Wage and Hour Division has released a proposal to increase the salary levels that determine employee exemption from overtime pay.  NLBMDA has submitted comments opposing the proposed doubling of the annual salary threshold that would serve as the new "bright line” test for the "white collar” worker exemption that applies to employees undertaking administrative, executive and professional duties at our operations.  Learn what this might mean for your business, and join in the discussion around how it will impact our sector.

Wage and Hour has also released an interpretation of the 6 factors it will use to determine if workers are properly classified as independent contractors rather than employees.  These factors must be considered as a whole, and no one factor will determine the relationship, creating a new standard of vagueness for employers.  Learn what guidance the government has provided and how this will need to be applied to the special circumstances of your independent contractor relationships.

About the Instructor:

Frank Moore, NLBMDA’s Regulatory Counsel, will review the Wage and Hour’s proposed overtime rule and the new independent contractor interpretation and facilitate an online discussion on the implication these will have on our sector.  Frank has worked with NLBMDA for the past 7 years and has served in a government relations and counseling capacity for trade groups for over 25 years.  He has also served as staff counsel on the former Committee on Banking, Finance and Urban Affairs in the U.S. House of Representatives.
